1. Acceptance of Terms

Welcome to JunkerClub ("Company," "we," "our," or "us"). By accessing or using our website at https://junkerclub.com and our services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

JunkerClub is an online marketplace that connects customers seeking junk removal services ("Customers") with independent junk removal companies ("Service Providers" or "Companies"). We do not provide junk removal services directly.

2. Description of Service

JunkerClub provides a platform that enables:

• Customers to post junk removal job requests with descriptions and photos
• Service Providers to view job requests and submit competitive bids
• Customers to review bids and select a Service Provider
• Secure payment processing through our platform
• Communication between Customers and Service Providers
• Rating and review system for completed jobs

3. User Accounts

3.1 Account Registration

To use certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

3.2 Account Types

Customer Accounts: For individuals or businesses seeking junk removal services.

Service Provider Accounts: For licensed and insured junk removal companies. Service Providers must maintain valid business licenses, appropriate insurance coverage, and comply with all applicable local, state, and federal regulations.

4. Service Provider Requirements

Service Providers represent and warrant that they:

• Hold all necessary licenses and permits required for junk removal services in their operating areas
• Maintain adequate general liability insurance (minimum $1,000,000 recommended)
• Comply with all environmental regulations regarding waste disposal
• Employ only authorized workers who are legally permitted to work
• Have appropriate vehicles and equipment for the services offered
• Will dispose of all materials in accordance with applicable laws

JunkerClub reserves the right to request proof of licensing and insurance at any time.

5. Payments and Fees

5.1 Payment Processing

All payments are processed securely through Stripe. When a Customer accepts a bid:

• The full bid amount is charged to the Customer's payment method
• Funds are held in escrow until the job is marked complete
• Upon Customer confirmation of job completion, funds are released to the Service Provider

5.2 Platform Fee

JunkerClub charges a platform fee (commission) on each completed transaction. The current fee structure is disclosed to Service Providers during registration and may be updated with notice.

5.3 Refunds and Disputes

If a dispute arises regarding job completion or quality:

• Customers may report an issue before confirming job completion
• Disputed transactions will be reviewed by JunkerClub support
• We reserve the right to withhold payment pending dispute resolution
• Refunds, if applicable, will be processed within 5-10 business days

6. User Conduct

You agree NOT to:

• Violate any applicable laws or regulations
• Provide false, misleading, or inaccurate information
• Circumvent the platform to avoid fees (e.g., arranging off-platform payments)
• Harass, threaten, or abuse other users
• Post inappropriate, offensive, or illegal content
• Interfere with the proper functioning of the Service
• Create multiple accounts for fraudulent purposes
• Manipulate ratings or reviews

7. Limitation of Liability

JunkerClub is a marketplace platform only. We do not employ Service Providers and are not responsible for:

• The quality, safety, or legality of services provided
• The accuracy of job postings or bid information
• The conduct of Customers or Service Providers
• Any property damage, personal injury, or other harm arising from services
• Disputes between Customers and Service Providers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUNKERCLUB SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE.

8. Indemnification

You agree to indemnify, defend, and hold harmless JunkerClub, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the Service

9. Termination

We reserve the right to suspend or terminate your account at any time, with or without cause, with or without notice. Grounds for termination include but are not limited to:

• Violation of these Terms
• Fraudulent or illegal activity
• Repeated customer complaints
• Failure to maintain required licenses or insurance (Service Providers)

Upon termination, your right to use the Service ceases immediately. Pending payments for completed jobs will be processed according to our standard procedures.

10. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or prominent notice on our website. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Los Angeles County, California.
